EULA - End User License Agreement

END USER LICENCE AGREEMENT

IMPORTANT
Read carefully all the terms and conditions of this agreement prior to running the
product or using any part of the productorits associated documentation. We ask you to review
and either accept the terms of the Demonstration End-User
License Agreement (EULA). The product will not be set up on your computer unless
or until you accept the terms of the EULA.You may print a copy of this EULA
or a copy may be obtained from Synergetix Limited, 6 Blake Street,Ponsonby,Auckland,
New Zealand or by emailing your request to tony@synergetix.co.nz If you do not
accept this agreement immediately return the entire system including any CD-ROM to your
computer dealer. This Synergetix EULA is a legal agreement between you (either an individual or
a single entity) and Synergetix Limited for the Synergetix Limited products
accompanying this EULA, which include(s) computer software and may include
"online" or electronic documentation,associated media, and printed materials
(SOFTWARE PRODUCT). By installing,copying, or otherwise using the SOFTWARE
PRODUCT or any UPDATES (as defined below),you agree to be bound by the terms of
this EULA. If you do not agree to the terms of this DEULA, do not install, copy,
or otherwise use the SOFTWARE PRODUCT; you may, however, return it to your place
of purchase for a full refund. In addition, by installing, copying, or otherwise
using any updates or other components of the SOFTWARE PRODUCT that you receive
separately as part of the SOFTWARE PRODUCT (UPDATES), you agree to be bound
by any additional license terms that accompany such UPDATES. If you do not agree
to the additional license terms that accompany such UPDATES, you may not install
copy, or otherwise use such UPDATES.

The names of companies, products, people, characters and/or data mentioned herein
are fictitious and in no way intended to represent any real individual, company,
product or event, unless otherwise noted.

SOFTWARE PRODUCT LICENSE
The SOFTWARE PRODUCT is protected by copyright laws and international copyright
treaties, as well as other intellectual property laws and treaties.
The SOFTWARE PRODUCT is licensed, not sold. NOTE: The terms of a printed, paper
EULA which may accompany the SOFTWARE PRODUCT supersede the terms of any
on-screen EULA found within the SOFTWARE PRODUCT.

COPYRIGHT
All title and intellectual property rights in and to the SOFTWARE PRODUCT
(including but not limited to any images, photographs, animations, video, audio,
music, text, and "applets" incorporated into the SOFTWARE PRODUCT), the
accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned
by Synergetix Limited or its suppliers. All title and intellectual property rights
in and to the content which may be accessed through use of the SOFTWARE PRODUCT is
the property of the respective content owner and may be protected by applicable
copyright or other intellectual property laws and treaties. This EULA grants you
no rights to use such content. All rights not expressly granted are reserved by
Synergetix.

Duplicating the CD-ROMS or copying any part of the system and all documentation is
strictly forbidden except as permitted in the following licence agreement.

(1) Title to the software ("licenced software") is not transferred to the customer.
The customer is granted a non-exclusive licence to install and use the licenced
software on any computer for the sole purposes of evaluating and demonstrating
the product.
(2) You may not copy the installation CD-ROM. You may make as required, copies of
the data files for backup purposes only. You may not make copies for any
other purposes or copy other parts of the system including documentation.
(3) You may not transfer this licence to another party without the written consent
of Synergetix Limited. On transference of the licence you must immediately
remove all copies of this software from your computer system and erase all
backups excepting those that are required by law.

UPGRADES.
If the SOFTWARE PRODUCT is labelled as an upgrade, you must be properly licensed
to use a product identified by Synergetix as being eligible for the upgrade in
order to use the SOFTWARE PRODUCT. A SOFTWARE PRODUCT labelled as an upgrade
replaces and/or supplements the product that formed the basis for your eligibility
for the upgrade. You may use the resulting upgraded product only in accordance
with the terms of this EULA. If the SOFTWARE PRODUCT is an upgrade of a component
of a package of software programs that you licensed as a single product, the
SOFTWARE PRODUCT may be used and transferred only as part of that single product
package and may not be separated for use on more than one computer.

DISCLAIMER
Synergetix Limited shall not be held liable for any loss or damage whatsoever,
arising from the use, misuse or inability to use the system. In any event the
total liability of Synergetix Limited shall not exceed the lesser of the
recommended price of the system and the price actually paid. Synergetix Limited
makes no warranty, either expressed or implied as to the suitability of this
system for any specific purpose or application.

WARRANTY
Synergetix Limited warrants for a period of ninety (90) days from date of purchase
all component parts of this system to be free from defects in materials,
workmanship or errors in programming. During this period Synergetix Limited
undertakes to correct or replace any component part shown to be defective and to
correct any proven errors in programming provided that sufficient information is
received to locate and correct any such errors.
